Terms of Service

1. Acceptance of Terms

By creating an account, submitting a work, or otherwise using HumanMade (humanmaderegister.com), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. About HumanMade

HumanMade is a public registry and badge system operated from New Zealand. It allows musicians and creators to declare that their work was made by humans - backed by visual evidence, collaborator verification, and a unique serial number.

HumanMade is not a legal certification body. Registration does not constitute proof of copyright ownership, legal certification, or any statutory intellectual property protection. It is a public declaration of human authorship, supported by community-driven review.

3. Eligibility

You must be at least 16 years old to use HumanMade. If you are under 18, you represent that you have your parent or guardian's permission to use the service. We do not knowingly collect data from anyone under 13.

4. Your Account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You must provide accurate information during registration and keep it up to date. If you suspect unauthorised access, contact us immediately.

5. Registration Fees & Payment

Registration costs USD $3.50 per song:

  • Single or Visual Art: $3.50 (1 song)
  • EP: $10.50–$21.00 (3–6 songs)
  • Album: $35.00–$56.00 (10–16 songs)

Bonus: Every 10th song you register is completely free. Once you've registered 10, 20, 30, etc. songs, the next submission that includes that milestone is free.

Payments are processed by Polar.sh. HumanMade does not store your payment card details. Fees are displayed clearly before you complete your order.

Fees are non-refundable once your registration has been processed and a serial number assigned. If we fail to process your submission, you are entitled to a full refund.

EU customers: By clicking the payment button, you expressly consent to immediate performance of the service and acknowledge that you lose your 14-day right of withdrawal once registration is complete and your serial number is issued.

6. What You Submit

You retain full ownership of all content you upload - including artwork, images, and metadata. By submitting, you grant HumanMade a non-exclusive, worldwide, royalty-free licence to host, display, and reproduce your submitted content solely for the purpose of operating the registry (public verification pages, badge generation, search results).

You represent and warrant that you have the right to submit the content and that it does not infringe any third party's intellectual property rights.

7. Public Display

By registering a work, you understand and agree that the following will be publicly visible on the HumanMade registry: your artist name, work title, registration number, cover artwork, and release date. This transparency is fundamental to how the registry operates.

8. User Conduct

You agree not to:

  • Register AI-generated content as human-made
  • Submit content you do not have the right to register
  • Provide false or misleading information about your identity or creative process
  • Abuse the community flagging system (e.g., filing flags in bad faith)
  • Attempt to access other users' accounts or circumvent platform security
  • Use the service for any unlawful purpose

9. Community Flagging & Review

Any registered user may flag a submission they believe contains AI-generated content or is otherwise fraudulent. Flagged submissions are reviewed by the HumanMade team.

HumanMade reserves the right to revoke any registration and badge if the submission is found to be fraudulent or in violation of these terms. Fees are not refunded in cases of revocation for misrepresentation.

10. AI Detection

HumanMade may use automated tools to assist in reviewing submissions for AI-generated content. These tools support - but do not replace - human review. No submission will be rejected or revoked solely by an automated system. You can contact us if you wish to contest any review outcome.

11. Copyright Takedown (DMCA)

If you believe content on HumanMade infringes your copyright, you may submit a takedown notice to legal@humanmaderegister.com containing:

  • Identification of the copyrighted work and the infringing material
  • Your contact information
  • A statement of good faith belief that the use is not authorised
  • A statement under penalty of perjury that your notice is accurate
  • Your physical or electronic signature

We will respond to valid notices promptly and may remove or disable access to the material. The submitter will be notified and may file a counter-notice. Repeat infringers may have their accounts terminated.

12. Limitation of Liability

To the maximum extent permitted by law, HumanMade's total liability for any claim arising from your use of the service is limited to the fees you have paid to HumanMade in the 12 months preceding the claim. HumanMade is not liable for any indirect, incidental, consequential, or punitive damages.

HumanMade is not liable for any copyright disputes, plagiarism claims, or losses resulting from the use or display of registration badges.

Statutory rights: Nothing in these terms excludes, restricts, or modifies any rights you have under the New Zealand Consumer Guarantees Act 1993, the Australian Consumer Law, or any other mandatory consumer protection law that cannot be excluded by agreement.

13. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the service - except where required by law.

HumanMade does not guarantee that the registration of a work will prevent unauthorised copying, AI replication, or any other misuse of your creative work.

14. Indemnification

You agree to indemnify and hold HumanMade harmless from any claims, damages, or expenses (including legal fees) arising from: (a) content you submit, (b) your breach of these terms, or (c) your infringement of any third party's rights.

15. Termination

You may close your account at any time by contacting us. HumanMade may suspend or terminate your account if you breach these terms. Upon termination, your right to use the service ceases immediately.

Registry entries for verified works may remain publicly visible after account closure as part of the permanent registry record. See our Privacy Policy for details on data retention and deletion.

16. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on the platform at least 30 days before they take effect. Your continued use of HumanMade after changes take effect constitutes acceptance.

17. Governing Law

These terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.

EU customers: If you are a consumer in the European Union, you also have the benefit of any mandatory provisions of the law of your country of residence. You may bring proceedings in the courts of your country of residence. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

18. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
